Constable's Widow Keeps Her Real Estate
June 2024
On June 26, 2024, we won a lawsuit against Mount Calvary Missionary Baptist Church in Houston, Texas as the result of a jury trial.
Why in the world were you in litigation with a church, Kimberly? Great question: this particular church was suing my client, a hardworking, lovely woman whose husband owned a parcel of land that was occasionally used as this church's overflow parking lot. He bought the land from a relative, and the church claimed that person did NOT have the authority to sell the land to him even though his deed was the last genuine recorded deed in the Official Public Records of Harris County, Texas.
Sadly, my client's husband, a local constable, passed away and left this property in his estate. With him out of the way, the church went after her to pursue the land, even hosting a "deed burning ceremony" on Easter Sunday in 2023. Pageantry aside, the community saw through the smoke screen and came to the right conclusion: my client's husband was the last owner of record, the payor of the property taxes, and the distribution deed from his estate to his wife was valid.
